City of Saratoga Springs Code on Sidewalk Maintenance

City of Saratoga Springs places full responsibility on homeowners for maintaining sidewalks in front of their homes.  This includes general year-round maintenance as well as winter-specific snow and  ice removal from sidewalks, to maintain safe, clean and smooth pedestrian walkways.  The full City of Saratoga Springs Code: Article  X on Care of Sidewalks covering general year-round repair of sidewalks, as well as seasonal snow and ice removal) may be accessed by clicking on the following link:

REPRINT OF PERTINENT PORTIONS OF CITY CODE ON SNOW and ICE REMOVAL FROM SIDEWALKS
Basically the pertinent portion of the Code regulating snow and  ice removal for all homes, including Travers Manor, is found in Sections 203-26 and 203-27 of City of Saratoga Springs Code:  Article X.  These two sections may be accessed by clicking on the link shown above  (which also accesses a section on general year-round sidewalk maintenance and a section on penalties), and the applicable sections on snow and ice removal are reprinted as follows:

Section 203-26.  Snow and ice removal.
The owner, occupant or person in charge of an improved or unimproved lot adjoining a City street shall remove the snow from the sidewalks in front of such lot within 12 hours after each snowstorm and shall keep the sidewalks clear of snow and ice and, when slippery, keep the same safe by sanding. The portion of the sidewalk required to be kept free from snow and ice is the portion thereof which is paved, if any, and if no portion thereof is paved, a space at least four feet in width shall be kept free and clear as above stated. A storm ceasing after 7:00 p.m. shall be considered as ceasing at 7:00 a.m. the following morning.



Section 203-27.  Placement of Snow and Ice in Streets.
No person shall, in removing snow or ice from the sidewalk or property adjoining a public street, cause the same to be placed in or upon such public street.

Essentially the Code states that the owner or occupant of a parcel must remove snow within 12 hours after a a storm ends. (The City enforces the Code 24 hours after a storm ends.)  Also, the owner or occupant is required to keep the sidewalk free of ice.  Moreover, the City fine for failure  to remove snow or ice is $250/day, as set forth in Chapter 1, General Provisions, Article III, of this code (referenced in the link shown above but not stated in this specific link). Also, the State fine for failure to remove snow or ice is $1,000/day. 

Please also note that placement of snow and ice in the streets is strictly prohibited by the City.

TRAVERS MANOR STATEMENT ON SNOW AND ICE REMOVAL FROM SIDEWALKS
"While Travers Manor has a standing contract with our service provider to commence snow removal operations when new storms measure two inches (2") or greater, and our contractor will apply ice melt on public perimeter walkways (up to ten times per year*), homeowners have full responsibility for removing new snowfall depths of less than two inches (2") on all walkways and driveways.  Homeowners are also responsible for applying friction materials such as salt, sand or calcium chloride to driveways and entrance paths (as the Travers Manor maintenance contract is limited to application of ice melt on public perimeter walkways)."  Homeowners should also apply friction materials to public perimeter walkways between post-cleanup applications made by our contractor on these walkways.

SUMMARY:

Cleveland Brothers Landscaping Responsibility:
Cleveland is responsible for removing new snowfall in excess of two inches (2").

Cleveland will apply up to ten applications of ice melt per year to public perimeter walkways.

Cleveland is not responsible for applying friction materials (
salt, sand or calcium chloride) to entrance pathways and driveways.

Homeowner Responsibility:
-- Homeowners are responsible for removing new snowfall less than two inches (2").

-- At all times after and between storms or after prior ice melt applications by Cleveland, homeowners are responsible for application of salt, sand or calcium chloride (preferred) to sidewalks in front of their homes that are used by pedestrians, to remove ice or hard-pack or otherwise remove dangerous conditions.*

*  Always, the homeowner should apply friction materials after and between snowstorms and/or applications, to keep sidewalks safe for pedestrians.  The legal liability for keeping sidewalks safe resides with homeowners, according to the City Code--even if Cleveland removed new snowfall in excess of two inches per contractural obligation. However, IN THE EVENT THAT ICE MELT APPLICATION by our contractor on public perimeter walkways reaches a maximum frequency of ten applications, and between contractor applications as necessary, homeowners will be responsible for applying friction materials on public perimeter walkways.
